3. Notice of Infringement

If you believe material on our services infringes your copyright, send the designated agent a written notice that includes:

  1. The physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material claimed to be infringing, with enough information, such as a URL, for us to locate it.
  4. Your name, address, telephone number, and email address so we can contact you.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, is liable for resulting damages, including costs and attorneys' fees.

4. Our Response

When we receive a notice that substantially meets these requirements, we remove or disable access to the identified material promptly and notify the affected user or customer. We may forward a copy of the notice, including your contact information, to that user or customer.

5. Counter-Notice

If you believe material was removed or disabled by mistake or misidentification, send the designated agent a written counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district of your address, or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

We send a copy of the counter-notice to the person who submitted the original notice. Unless that person tells us within 10 business days that they have filed a court action to restrain the alleged infringement, we restore the material no sooner than 10 and no later than 14 business days after we receive the counter-notice.

6. Repeat Infringers

In appropriate circumstances, we terminate the accounts and services of users and customers who are repeat infringers.
