Terms of Service

1. Who we are

These sites are operated by TPL Music - Hardly Creative LLC: Hardly Creative (hardlycreative.com), Main Street Sites, Good Tool and Good Day Sites. By using them you agree to these Terms; if you do not agree, do not use them. Our mailing address and contact are above.

2. Using the sites

Do not interfere with the sites, bypass access restrictions, impersonate anyone or submit unlawful material. We may refuse service to anyone and remove or refuse any content, at our discretion.

The sites, calculators and articles provide general information only. Outputs depend on inputs and assumptions, may contain errors, and are not financial, tax or legal advice. Do not rely on them or on any marketing, advertising, ranking, traffic, sales or earnings result; none is guaranteed.

We own or license the site materials and software. You keep ownership of material you submit, and you grant us a worldwide, royalty-free license to use, copy, modify and display it to operate and promote our services. Third-party sites we link to have their own terms and privacy practices.

3. Paid work, privacy and copyright

Paid design, consulting and hosting work is governed by the order and any service schedule accepted when it is purchased. The Main Street Sites hosting schedule is in section 6.

Our Privacy Policy explains how we handle information. Copyright notices follow our DMCA and Copyright Policy, which is part of these Terms.

4. Changes, suspension and termination

We may modify, suspend or end any site or service, and change prices and these Terms, at any time. Changes are effective when posted or communicated to you. Continued use is acceptance.

5. Disclaimers, liability and law

THE SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR LOST PROFITS, REVENUE OR DATA, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE PRIOR 12 MONTHS, OR $100 IF YOU PAID NOTHING.

You will indemnify and hold harmless TPL Music - Hardly Creative LLC and its owners, personnel and affiliates from claims, losses and expenses, including attorneys' fees, arising from your use of the sites, your content or your breach of these Terms.

South Dakota law governs these Terms. Any dispute must be brought in the state or federal courts located in South Dakota, and you consent to their jurisdiction.

6. Main Street Sites hosting schedule

Your provider is TPL Music - Hardly Creative LLC, doing business as Main Street Sites. Service contact: irena@hardlycreative.com.

Plan and price. The standard plan hosts one business website with the monthly content edits shown at checkout. After a free trial it renews monthly at the price shown at checkout until you cancel. Additional edits are available at our discretion and may be charged separately. Premium or custom-domain projects require a separate written order.

Cancelling. Cancel by emailing irena@hardlycreative.com from your account contact address. Cancel before the trial ends and you are not charged. Cancelling later stops future renewals, and your site stays up through the period you have paid for. Fees are not refunded except for billing errors and where the law requires.

Your content. You confirm you can act for the business and have the rights to the materials you supply. You keep ownership, and you authorize us and our providers to copy, edit, display, back up and publish them as needed to run, promote and update the site.

Limits. We do not guarantee search rankings, traffic, sales or uninterrupted hosting. We may suspend or remove a site or content at any time, including for unlawful use, infringement, malware, payment failure or security risk. If your site collects visitor information, your business is responsible for a notice to its visitors.
